This page sets the terms and conditions of this platform where E&M Creative Limited supplies printed materials, promotional items, and display solutions to businesses and individuals (persons aged 18 years and above) in Kenya. Please read these terms & conditions carefully because by ordering or paying for any service, you agree to be bound by these terms & conditions.

1. Information About Us – Who We Are

E&M Creative Limited (“We”, “Us”, “Our”) is a registered company based in Nairobi, Kenya. We specialize in events display, promotional items, and professional stationery.

2. About You (“the Client”, “Buyer”)

By using our services or website, you consent to us using your personal information ONLY for the purpose of processing your order and providing our services. By placing an order, you agree that:

  • You are a person aged 18 years and above.
  • You are legally capable of entering into a binding contract.
  • The contract between you (“the client”, “buyer”) and us is formed after you successfully place an order by making payment or by signing a formal service agreement with us.

3. Use of Our Artworks (Designs)

We design artworks for our clients. The artwork can be done before placing an order for your approval or after you place an order.

  • Approval: You must proofread and confirm the artwork/design is correct before we start production. By approving, you agree that we will not be responsible for any typographical errors or details skipped.
  • Responsibility: We are responsible for product quality (material quality, print quality, and product finishing – cutting, binding, lamination, branding, and assembly). This same policy applies to artworks provided directly by the client.

4. The Information/Materials You Provide

The information you provide for printing must be accurate, original, and comply with Kenyan law.

  • Content Must NOT Be: Defamatory, offensive, sexually explicit, or promoting violence.
  • Anti-Discrimination: Content must not be discriminatory based on ethnicity, gender, race, religion, disability, language, pregnancy, marital status, physical appearance, socioeconomic status, political affiliation, skin color, or age.
  • Legality: Content must not promote illegal activities, infringe on copyrights/trademarks without proof of ownership, or involve counterfeit documents (e.g., fake IDs or certificates).

5. Delivery

Any order placed with E&M Creative Limited will be delivered to the address provided.

  • Timelines: Delivery typically takes 1-3 working days for small orders and up to 14 working days for large-scale productions.
  • Notification: You will receive notifications regarding your order status via our official company email or phone numbers.

6. Quality & Color Variations

We strive for excellence in every print. However:

  • Color Matching: You agree that slight color variations may occur between digital screens and physical prints.
  • Pantone Codes: Providing Pantone color codes is highly recommended to ensure original colors. We cannot be held liable for color variations if Pantone codes were not provided.
  • Errors: If a production error occurs on our side, we will reprint your work and deliver it to you at no additional cost.

7. Risks & Ownership

Immediately upon receipt of the materials (printed or non-printed), you become responsible for them. Risk and ownership of the products pass to you upon delivery.

8. Prices & Payment

  • Price Adjustments: Prices may change due to fluctuations in the market price of paper, ink, or branding materials. This does NOT affect orders already placed and paid for.
  • Secure Payment: Online payments are processed via secure, independent payment gateways. You may choose to pay via M-Pesa, debit/credit cards, or other available electronic payment methods.

9. Return Policy

If the supplied items do not match the specifications of your approved order or artwork, you may return them to us. In such scenarios, E&M Creative Limited shall offer to reprint the work and deliver it to you at no additional cost.

10. Privacy Policy

Your information is safe with us. E&M Creative Limited only collects contact details (name, phone number, email, and delivery address) necessary to process your order. We do not store your payment information on our servers; all transactions are handled by secure, independent third-party processors.

Please be aware that we reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon being posted. Continued use of our services indicates your acceptance of the updated terms.
